The will checklist
Everything the questionnaire will ask, gathered in advance — so the twenty minutes actually takes twenty minutes. No download, no email address, just the list. Print this page if paper helps.

People
The decisions that need thought
- Executor, and a backupOrganised, available, ideally in your province and a generation younger. Ask them first.
- Guardian for minor children, and a backupThe values-capacity-disruption test. Ask them too — and their spouse.
- Trustee for children's moneyCan be the executor; a different person adds oversight for large sums.
- Attorneys for property and personal careWho runs your finances and your medical decisions if you cannot. Backups for both.
- Pet guardianAnd a fallback rescue organisation if they cannot take the animal.
- Everyone's full legal names and addressesThe will identifies people precisely; 'my cousin Dave' is litigation bait.
Beneficiaries and gifts
Decide before you start
- Who shares the residue, in what percentagesThey must total 100. Decide the split before the questionnaire asks.
- What happens if each beneficiary dies firstTo their children, to the survivors, or to a named alternate.
- Specific giftsNamed items to named people. Keep it to things you will still own.
- Charitable bequestsExact legal name and CRA registration number — look them up on the CRA charity list.
- The inheritance age for young beneficiaries18/19 is the default if you say nothing. Most people choose 21 or 25.
Assets
Gather, don't perfect — estimates are fine
- Real estateAddress, rough value, mortgage balance.
- Bank and investment accountsInstitution and type. Exact balances not needed.
- Registered accounts: RRSP, RRIF, TFSA, FHSA, RESPAnd who each names as designated beneficiary — this is the big one.
- Life insuranceInsurer, rough coverage, and the named beneficiary. Include group coverage at work.
- Vehicles, valuables, digital assetsAnything that needs a plan: the car, the ring, the crypto, the photo library.
- DebtsMortgage, loans, cards — the net picture your executor will need.
Wishes
Five minutes of reflection
- Burial or cremation, and any ceremony preferencesGuidance for your executor rather than binding law — still worth recording.
- Pain management and life-prolonging treatmentYour personal-care attorney should not have to guess. Recorded in the POA documents.
- Anything unequal, explainedIf shares differ or someone is left out, write a dated memo of your reasons and keep it with the will.
For signing day
After the documents are generated
- Two witnesses18+ (19+ in BC), neither a beneficiary nor married to one. Neighbours are the classic answer.
- A pen and twenty minutesEveryone in the same room, everyone signs the same original, everyone initials each page.
- An affidavit of executionSworn by one witness before a commissioner — not required for validity, saves probate pain later.
- A storage planFireproof box, lawyer's vault or court deposit — and tell your executor where.
The one check that outranks the whole list
Your registered accounts and insurance pass by their designated beneficiaries, not by your will — and stale designations override new wills. Confirm every one before you sign anything.Why this matters so much.
